Reference is made to the stock exchange notice 17 June 2026 regarding the Norwegian State's loss in the appeal case against the NGOs. Nordic Mining ASA ("Nordic Mining" or the "Company"), has through its subsidiary Engebø Rutile and Garnet AS ("ERG") submitted an application to the Norwegian Ministry of Climate and Environment for a temporary discharge permit, pursuant to Section 11 of the Norwegian Pollution Control Act.

The application concerns a temporary discharge permit for tailings from Nordic Mining's operations at Engebø, where the company produces rutile and garnet, critical minerals and titanium feedstock essential to modern industries in Europe and globally. Nordic Mining is not a direct party to the Supreme Court case, and the ruling does not affect current operations at Engebø. The temporary discharge permit application is intended as an extension and in parallel with the existing permit while authorities assess implications of the ruling.

"As a consequence of the Supreme Court ruling, we have submitted an application for a temporary discharge permit to ensure a predictable framework for continued operations. While activities at Engebø continue as normal, establishing clear conditions for future operations is important", says Finn Ivar Marum, CEO of Nordic Mining.

Strong support from Norwegian authorities

Despite the outcome in the Supreme Court, Nordic Mining notes the continued support from Norwegian authorities. The Company remains confident in the robustness of its documentation and its long-term ability to operate at Engebø in accordance with strict regulatory requirements.
